If you were only there two and a half months then the employer has every right to terminate employment. Most employers place new employees under a 90 day probationary period to determine if the employee is dependable. So it seems you got canned right before that 90 day period was about to conclude. I would still contact the labor department or a labor management attorney to discuss what options may be available to you. GOOD LUCK!!!!!!!

So what are they actually firing you for? Is it because you've had to take masses of sick leave? You need to read your contract, but also, you need to find out your rights from someone who know about employees rights etc. Know your rights, and take it from there, something doesn't seem right, but then, I don't know all the details, even so, it shouldn't be this easy just to fire somebody like this. You'd have to go over the specifics of the situation with a lawyer to know if what they did is legal or illegal. Size of the business comes into it -- a very small restaurant might be not subject to rules that a larger place is subject to. The agreement you signed when you got hired -- is this a fire-at-will place? Whether you have been absent a lot (especially when they were expecting you, did you give them short notice a lot?) Things like that.
