It is new laws in Victora, Australia - just came in last year. You have to do both a working with children check and a criminal record check.. He has some violence and substance issues in his criminal history but nothing for the last 5 or 6 years, however they go back 6 years and the check goes back 10 years. Any offense warrant you to go to a tribunal and plead ur case.. but I am sure he is putting it off as he is scared of the outcome and I want to go forward asap as I am nearly 32!!
Possibly it is different in Australia, where the poster lives.
my clinic did not do a background check at all.
now if you end up trying to adopt it may be a big issue depending on the offense and your state....
I'm just curious-- is your RE requiring a criminal background check before treating you? My husband nor I submitted any info like that nor did we go through psychological testing. I find that very interesting. But like the previous poster, I would expect it to be off his record by now if it were minor and during adolescence.
if he was a minor it should be off his record, as long as it was not something related to abuse or neglect of a child it shouldnt make a diffrence u might look it up online and see if there is any laws regarding this in your state
I'm a little surprised that there is a criminal background check, though it does seem logical that they would want to know if someone is a convicted child abuser. We had to do psychological testing, and frankly I don't know if they did a criminal background check or not. You could get a lawyer to contact the clinic and ask (anonymously of course regarding yourselves) what kind of background check the clinic does, and what kind of crimes would prevent you from accessing IVF treatment. (Youthful theft or vandalism convictions don't seem like a deal-breaker to me, for example.) If they were to explain to the lawyer what is going on in that way, you would know whether to complete the forms or not.
