Used needle

Hi there!
A question out of curiousity.
Considering an HIV infected syringe which appears to be empty is used to draw blood from another person, will that person be infected with HIV?
And if a person draws blood from that syringe, will he be able to realise that syringe is used?(syringe is empty)
The syringe in this scenario uses sterile needles, not disposable ones.

This is something you really should not be worried about.

Sir, you mean HIV can't be contracted this way? or such situations don't happen?
What if a HIV positive nurse wanted to give HIV deliberately this way( drawing blood)?
Please reply sir, a YES or No would do.
