Hi All, LTNS

Wish me luck on my civil trial against the hospital that infected me.  it begins a week from tomorrow.  Been three years coming!

Don't let them bully you, the bloopsters!!

Does it make you think they're afraid they'll lose if you do appeal?
What does your lawyer think?

If it were me, I'd make a big stink, call the local news stations and whatever other media I could think of.

Unbelievable. The hospital's attorney has come back and said they will sue me for their costs and fees if i don't sign a waiver saying that I will not appeal.

I just stumbled onto this. Like everyone else, I too am very sorry you're case was unsuccessful.
I'm curious whether you were able to present anything from Dr. Gish?
The scary truth is once we're sedated we don't know what happens. Its all about trust.

The great thing is you are HCV free!!

I can't remember what this is called but it's something to do with it being an amount that they give someone for wasting their time.  My brother got about the same when he had his lawsuit (which he didn't deserve to win and did not). I wish I could think of the word - I think they do it just to humiliate someone, sort of like leaving two pennies as a tip.  Like, well you had a point but we won too bad.

It's heart-breaking and the only consolation and hope is that the hospital may take more care in future.

My mom was involved in a class-action suit where everyone, including the hospital, completely acknowledged the contaminated hospital source had directly caused the serious damages - there was no question at all about that part.

The settlement was pitiful. My mom, who was in her seventies and permanently and seriously suffered as a result of the botching, got two thousand dollars. I remember how stunned she was, absolutely stunned, insulted and depressed that her suffering meant so little.

You did a great thing by getting out there and making this public and I hope you keep your spirits up.

Oh Deb there are just no words for any of us to explain how our hearts go out to you. I can't even think of anything else to add to that - you are a valient woman and they did find merit to put your case forward, if you saved somebody's life then you've done a wonderful thing.

Dam, no ones heard from her yet ?? I am wondering....should we have her last name (in that article) here? I guess as it's a public trial, news, it's ok. I just think of the whacko guy I had bothering me here for awhile.

  So, so sorry Deb. This happens far more then not. Dr.'s, hosp, clinics... are negligent and get off scott free, some loop hole, some minor doubt.
2 Yrs ago, a friend that works for a reputed law firm heard my story, told her lawyers, they had me come in. They reviewed and sent me to a malpractice firm they share cases with. They did all this free (as with a case for my dying sister) and in the end.....while gross negligence, while definite 'failure to diagnose' over a 10 yr period going there, while many blood test I'd had clearly showed high LFT's back to 2000......the 'proof of permanent damage' was just not provable,  the cost to handle the case for the other very provable issues, would exceed any damages they could get. They were willing, but it'd have to be a lot out of my pocket also, which I just couldn't afford to prove a point. Funny thing is....that Dr. office never did send my complete records, after several orders. That would have looked good in court! I had not been back to them since my acupuncturist sent me in for blood work, dx'd me. (for any evidence of permanent damage,etc). Permanent damage with us is just too hard to prove. As with our post tx issues...no on can ever say for sure. Had I hit cirrhosis , perhaps, but I was 'in time for my liver to repair', as my treating physician would end up saying on the stand.  Bottom line of course is permanent damage is the big bucks for attorneys, while that firm helped my family with other things, that case would have cost big bucks, big time, to much to do contingent or 'pro bono'. I did get the satisfaction of knowing that office HAD to have had meetings, some uproar just over the case, therefore hopefully making them more aware to look for and test for Hep C.
  Deb, as others said....you did get a lot of public attention, that hospital will be correcting issues now, many others also. Please take that, at least, as a 'win'. You got it to a court room, that is NOT easy in this. I am sure your disappointment is huge, I hope you will allow yourself the time to get over this and move past it. With mine, they called me in, I didn't expect much AND they are not who infected me. I know it's a terrible let down for you.

Can-do-man, thanks for posting the article and child24angel for pointing the way to the article.  It was a very comprehensive article chock full of very good information.

And to you, Deb ... regarding the above comments towards the end of that article, I'm sorry for your own personal losses in all this.  Just the same...perhaps .. the very best victory of all came out of it.  With the exposure this will have gotten, with them indicating that any of these places COULD have been a vehicle for transmission, ALL of these kinds of places will take greater care to monitor their methods and take steps to ensure that their practices are sound.  

You did the greater good at personal expense, Deb.  I'm sorry it could not have turned out better for you personally.  I'm amazed, proud and grateful for what you have accomplished in spite of your own losses.  Wonder how many people will be spared HIV, HCV or any number of possible health issues because greater attention to practices will be paid due to "more scrutiny of safety practices".  Hats off to you, Deb and hope the burden of your own personal losses in this situation are bearable.

Deb did not prevail in her law suit.
I feel like everyone does - terrible.
Proving causation was the problem - proving that she was infected at the hospital.
I could go on but that is the bottom line.

Yes but then others are full on DOCTORS of law with credentials in multiple states.  THAT is the kind of lawyer you would want in something as important at this.  Not someone who just thinks they are an expert of law or something - someone with a big, fat mouth but can't back it up in the slightest and wouldn't know case law if the big fat book hit them on the head. Gosh you see them around all the time people that think they are know it alls!

It's definitely important that you pick someone superior in mind and knowledge when dealing with something like this that you've waited for for so darn long - which has caused so many consequences to your life. You deserve to be paid back for it!  

I think you will be just fine you are a Deb like me and my friend we certainly are nobodys fool!   :)   ♥

I meant to add - I hope there's nothing precedent-setting about this, just a good old fashioned plaintiff's verdict with a big award.  That precedent stuff may sound good to laypeople, but it really just serves up material for an appeal !

Hey all you guys, my graduating class!

I'm doing all right. Too many issues two years post to number. Have been to Mayo for them and going to Cedars Sinai in LA after the trial.  Have the usual FM/CFS stuff (diagnosed) but also some interesting GI  issues.

They've already done what they could about coming at me pretty hard.  There's not a whole lot of room for the "what did YOU do to make it happen crap" because even their expert agrees that my case of heptatitis was the acute onset, due to how high the LFTs were, so there weren't and won't be a lot of the usual rude questions.....i hope.  they already asked them in the interrogatories.

back at ya, all my old (and any new) friends. Love ya'll

Hey Deb it's nice to see you post, how are you doing?  Must be nice to finally be at this stage - I can't wait to see what happens with this it would really be a landmark case if you could get it go through (plus boy it'd be nice to get some money out of them wouldn't it after all you had to go through because of it!).

I agree with Diane they are going to try pretty hard to get you on it but you just keep remembering all you had to do to get to SVR and use that strength to kick their butts for all of the people who have had this happen one way or another!
