I have transverse myelitis. similar to MS. Only a few people in my immediate organization knew about my diagnosis. i continued to work through the ordeal. Even while in the hospital I was attached to my laptop, making sure their business ran smoothly. I received a call from the head of HR yesterday, very threatening asking about my disease, prognosis and when i will be better. When I said there is no definite prognosis for spinal cord damage, she snidely said to me "than, there is no prognosis for your job". She then asked for my medical records (which i've already submitted multiple times) and hung up. When i go in to work monday i fully expect to be terminated. You can take these companies to court, but just remember - the more money they have, the more they can keep your legal team tied up until you've depleted all your money and drop the case. biig business owns all. good luck.
If he has an employee manual, check and see if it has an "employment at will" clause. This states an employer or employee can terminate the contract "at will" and not have to give a reason. It may or may not hold up in this case, as the termination happened directly after the "reveal", but it would be good to know as you pursue your options. I really wish you the best on this, and go immediately and file for unemployment. Amy

I DEFINATLY WOULD CHECK INTO HIS LEGAL RIGHTS.I ALSO HOPE HE STILL HAS THE E-MAIL AND WOULD MAKE A COPY OF IT.
THIS SEEMS TO FALL UNDER WRONGFUL DISMISSAL FROM A JOB.
THERES LAWS TO PROTECT HIM.

Get an attorney asap. If a company has more than 15 employees, he is protected. This discrimination cannot be allowed to stand! I know it's hard, especially when you have to worry about finances, but it is very important to pursue this vigerously. Best of luck.
I agree with both Quix and Spastic...I went through something similar and had to back track because I didn't realize they were doing illegal things. It turned out that I had to quit the job because the stress of fighting turned out to be too much for me but your husband has a definite case I believe!
You should have him contact your government office that deals with your civil rights and check out the website that Quix suggested. Then have him contact a lawyer right away...the quicker he gets on top of this the better the results will be.
Please let us know what happens ok...and we are here to support you though this struggle that should not be inflicted on anyone with a disability!

I am with Quix on this one. What they did is illegal, very illegal. This kind of thing really gets my blood boiling. I'm sorry this happened to him. My advice, talk to an attorney.

If you are in the United States you have an action against for Unlawful Termination under the Protection of the Americans With Disabilities Act! Unless the company has 15 or more employees the ADA protects employees with disabilites from being fired on the basis of their disability!!!!!!!
So, if you are in the US and the company is larger than 15 employees, your employer committed a federal offense and violated your husband's civil rights.
