too many refills

My daughters father has a very bad back injury, he was prescribed oxies and perocets for years and started abusing them, he eventually ended up in prison over it. He is now clean from oxies for over a year, but has been taking tramadol, the doctor wants him to start back on narcotics since the tramadol wont last forever. About two months ago he thought he was out of refills and called into his doc for a refill, it was sent to the pharmacy, the pharmacy told him no that it was two days too early so he transferred it to another pharmacy, a few days later he received a call from the old pharmacy that his prescription was ready to be picked up so he did, so for the last two months both pharmacies have been filling them. He pays cash for his scripts since he has no insurance. The other day he went to get his script from one of the pharmacies and they said it was cancelled by the doctor but hadn't been contacted by the doctors office about it. He was told the next day to turn in to the county jail for a probation hold but wasn't told for what. Is what happened illegal? I am guessing the hold is for the multiple prescriptions, but since they are from the same doctor is that the same as doctor shopping? He is not my boyfriend anymore and hasn't been for over two years, but I am wondering if they can charge him with this and send him back to prison, if so I need to prepare my child. We live in Wisconsin by the way, and I have been on google all day and can't find anything about this exact drug in any situation, only ones like oxies and percocets and vicodin and stuff. PLEASE help if you can.

Im curious how can you rob Walgreens for pills? How can you do that? *stratch my  head* I'm trying to figure it out here and can't figure it out, ha. Hope you don't mind to explain to me? Thanks. I'm truly sorry to hear about your situation and I am glad he is out. I hope he learn his lesson. Having double (same) prescription at two different pharmacy is No-No and of course it is illegal. However, I hope everything works out for you guys.

I'm really glad that he made it home for your daughters sake. You know as well as i that if he is all about "poor me" that he hasn't learned anything. All we can do is keep our fingers crossed for you and your daughters sake!! What have you found out as to exactly why the hold. Did it have anything to do with the extra scripts?

He did finally come home, I don't know if he learned his lesson or not, it is always poor him, so we will see. Just want to say thank you to everyone for the help, you are all amazing

You are such a GOOD Mom. She is so very fortunate to have you for her Mom. Not all children's Mom's know when and when not to tell them news, however you do.
Kudos to you for being so strong and loving to her.

The jail won't tell you if he has release papers or not, and his agent didn't return any phone calls. No I didn't tell her, I wanted to wait until I knew he was released.

Is there anyone that you can call to check with? Such as Lawyer, Jail, etc.?

Did you say anything to your daughter or did you hold off until he comes in person?

Well he still isn't out, I am starting to think she lied to him about it. And yes, I did have that talk with him just yesterday, I can't allow him to do this to her anymore.

I hope that he has learned his lesson also!!! You beautiful little Princess can only handle so much disappointment. Little ones bounce back quickly BUT can only handle so much with someone she loves and is counting on to be her "Prince".  

I'm sure that you've already done this, but maybe you might consider sitting him down and telling him that ENOUGH IS ENOUGH!!!! That you hope he is risking the love a BEAUTIFUL PRINCESS that thinks the sun rises and sets on him and NOT to HURT her like this again!!!! Like I said, I bet you've ALREADY had that talk with him.

I hope he learned his lesson too. This has been really hard on her and I. I don't want her to deal with this anymore. She is so wonderful, she is already reading short stories, loves painting and of course is a princess! She is so strong, and yet I think he takes that for granted.

I have been watching this post and I just wanted to say I hope this was a eye opener for him and since he needs the pain meds to try try not to use them wrong and try not to get into trouble with them. I wish there was another treatment for him but it sounds like there isn't. I hope he is able to spend some time with his daugher when he is out. With alot of people their kids is what wakes them up. I just hope it is that way in his case.

I'm so HAPPY that this has worked out so well for your sweet little girl so she can still see her Daddy that she loves SOOO much!!.

I hate to ask this, but do you think that MAYBE this time he has learned his lesson?
I hope so because he has to stop and think how his actions will affect that little 5 year old in his life.

He does get drug tested about 3-5 times a week. But good news, he just called earlier and his agent came to see him twice today and he will be released sometime tomorrow. He is pretty sure he has lost his job, but he is still a student, thanks to his brother and I handing in some of his assignments, hee hee. My daughter doesn't know yet, I am going to have him surprise her tomorrow. What happens next, I don't know, hopefully only better things! Thank you everyone!

I don't really understand what's to be gained by putting him in prison.  Wouldn't it better for all concerned to allow him to return to school but with some type of oversight.  Maybe periodic drug testing.

He's in an impossible situation pain wise.  Surely the authorities see that he needs some sort of pain relief.  But it doesn't seem that going back to prison is in anyone's best interest.

That was a horrific accident that he was in. It definitely changed his life forever. My what a shame that they wouldn't give him the surgery when he asked from the Dr. that your insurance would have covered. It might have changed the entire direction that his life took.

Alternative to Revocation is what it stands for. If he would go back the judge could give him up to 5 years since that is how long he has left on extended supervision. He was in a rollover accident in a car that someone else was driving, since he is so tall, and the side of the car where he was landed on the cement guard rail and slid about 50 feet, so his two lowest disk are mushed together and really thin on one side, he will have to have surgery sometime in his life, but since he is still under 30 they don't want to yet. When we finally found a surgeon willing to do it our insurance wouldn't cover that surgeon. He has tried spinal injections, physical therapy, those electric things they have you stick on and it pulses, even now like I said they want him back on narcotics because his doctor said that it is such a serious injury that even if he took 12 tramadol a day he would still be in extreme pain, so he takes that and soma for now since he isn't ready for the narcotics. He still asks for the surgery but so far it is still a no go.

Would you mind telling me what an ATR is? I'm not familiar with the abbreviation?  I'm still keeping my fingers crossed that for your daughters sake he doesn't have to go back to prison. If he does how long would he have to serve, how much time is left on his original sentence?

Yea he did, she just is not a very nice person. His lawyer is going to see him tomorrow and Thursday so hopefully she will have spoke to his agent by then and figure out what she is planning on doing. He said that they are supposed to offer him an ATR before revoking him, so we will see I guess.

He should tell his PO that his doctor has trying to get him back on narcotics and he refuses. This may help him.

It really ***** that he has no control when it comes to his meds because he really needs them. His doctor knows he is an addict but since his back injury is so bad he keeps pushing him to go back onto narcotics and he keeps saying no, I don't want to think how bad he would have gotten again if he was back on oxies or something.

Your post is so sad.  Thank goodness you're strong.  The situation is frustrating and confusing.  But with a mom like you, as strong as you are, your daughter will be fine.  It's so tough but you and your daughter will come out fine.

I am glad you did finally find out what was going on. I just can't figure out how this happened. The pharmacies must have found out he was filling the same script and called the police and then they found out he was on probation and they contacted his PO.
I am very sorry you had to tell your daughter this, No child should have  go through this kind of terrible thing. it effects them alot.
She is lucky to have such a great Mom:)
