FMLA

My husband just got hired on at the company he's been working for through a temp agency and they said he can't get fmla until he's been hired on for three months and I'm 30+1 already. Anybody else have this problem?

he has up to 1 year to take the leave so maybe he wont have all the time off at the same time you do but he can still take it and spend time with ur baby :)

Metra,  I'm not quite sure what you mean about them "paying" it.  As I understand it  they aren't required to pay for time off,  but after being employed for a certain amount of time the employer is required to allow him time off.

How much time does he need to take off for the birth of your baby?  My husband took off two days each birth -

If they have 50 or more employees they have to offer it.

I would be lost without my fmla I have massive migraines and severe morning sickness and my work is great! I wish more companies would adapt to that even though its all unpaid but still I would be lost!

Fmla is a federal law that says if you have been employed for 1tee or have worked 1250 hrs the company must hold your position or one similar with same pay for 12 weeks and in some cases 26 weeks. So if you are under a year it is a courtesy but you have no protection. I am an Human Resources Manager so I deal with this question all the time.

Yea FMLA is basically just a contract for your employer and you stating that during this specific time off you will not loose your position, however they will work with you. I was so nervous since I am having my child in less than 4 month, and I couldnt use it. but I also got the shaft too since I cant use any of the my vacation time that I accure until after I have been there for 6 months. So for 6 weeks I will have no income coming in. :( So time to save lol. Good Luck Hope they can let him off a few days for ya.

Yes Certain employers do not offer that as a benefit until their probation period is up. I just started my new job today and I am 21 + 2 weeks, My FMLA )Maternity leave is not covered until I am employeed their for 1 year. However they do give me 6 weeks maternity leave and thats it. They have too because I am pregnant they cant make me come back to work the next day. When it comes to your husband have him work something out with his employer, he might be able to get a week off or a couple days. It most likely wont be paid but at least a little time off to help. Keep in mind most employers look at the mother needing the majority of the time off as you are the one who actually gave birth and strained the body. The husband is often given time off to give support and help/bond with child.
