Child support question

My donor decided to marry 2weeks before I give birth to his child. Lovely right? Well we already have a 7 y/o together with a child support order in which he is 16+ in arrears. We came up for review of modification to up his pay but the courts claiming to not be able to serve him. My child gets no cs even though he does work. Now that he is married can the courts petition his wife to help him pay arrears and support?

I wld talk to a lawyer or look up the law in your state because it is different in every state. My husband and his daughter's mother actually have an agreement set so WE actually pay monthly but it's not through the courts. Frm my point of view I am jus as responsible for the child support as my husband. She is not my biological daughter, but my husband's responsibilities became mine the moment I said I do and he made it very clear before we even started dating that he wld not stop paying child support if and wen we got married and made sure I was ok wit that because we believe wat is his is also mine and vice versa. Honestly it amazes me how some thinks they can marry someone wit children and not also be responsible for those children. I will never be her mother nor wld I ever try but wat affects my husband affects me and his daughter and our son and daughter that we're expecting! Honestly I cldnt have married a man who had children he didn't take care of...if he can't take care of his daughter I would have questioned him taking care of any future children we had together...but that's another convo lol be encouraged and ignore the negative comments!!!

Lol..it's funny how she just married the guy and someone is already plotting to take her hard earned money. You should get a lawyer though. Peoples opinions might not be accurate. These laws differ from state to state.

If he has a job and isn't paying child support then you need to take him to court if you haven't already.

I didn't ask to be ******* criticised!!! I know in most states the spouse take over any and all debts that's not being paid. If you couldn't just reply with an answer without insults you should go on to the next post.
Thanks to the moms who answered without trying to down talk.

Here in south carolina she can even tho its not fair to her. They can even up it bc now there is two incomes in one household. You should definitely look into it. Just like if they file taxes together

You need to see a lawyer or look at getting govwrnment assistance if thats the case,  but the new wife is not, nor should she be responsible for YOUR kid. The child support issue is between you and your ex.  If I was the new wife.. I certainly wouldn't be bothered with it.

I don't know the law here but I don't think the wife should ever pay child support for her husband's child that is not hers what if she will have her own child it will be unfair sorry...

No his wife and her income will never come into play simply because she's not a parent to the child biologically.
