I will definately run this by my dentist on my next cleaning next month, any other advise you can give?

Checking the bite, the right way, is more than just shaving one tooth. There is quite a bite that needs to be evaluated and all the teeth, where they meet one another, and the way your jaw opens and closes and moves need to be evaluated, even at times you joints. This could be a signal that there is much more going on than meets the eye and if caught early enough it could prevent some major damage. So in reality, this could be a blessing in disguise, and if you take care of it now, you will be able to protect the rest of the teeth. Take a look at these two links and it might help a little.

I forgot to mention my regular dentist shave the bottom filling as much as possible on my second visit, it helped slightly but there was still pain, anything else it could be??
Did either of these dentists check your bite/occlusion? Sounds like the bottom filling might be a little high, which could be putting added pressure to your upper tooth and cause the exact symptoms you mentioned. I would have this checked first, as the fix is very easy.
