2nd failed IVF, assisted hatching mistake made

Hi everyone. I am wondering if anyone can lend some insight into my situation.

I'm 39 years old and my husband and I have been thru two failed IVF cycles. The first was a fresh cycle, they retrieved 17 eggs and 9 of them fertilized. Two were "put back" at transfer and 2 didn't make it to day three for freezing, so we had 5 frozen embies. First cycle I developed OHSS, which got very bad. My doctor prescribed percocet for the pain, which surprised me. Anyway, first cycle failed. I started my AF prior to the blood HCG.
2nd cycle was in June. It was a FET and 3 embryos were transfered, 4 were thawed. (Leaving us now, with one). I just found out on Monday that the 2nd attempt failed.
Both cycles were supposed to include assisted hatching, due to my age. We found out that not only didn't they do it this past cycle, they also didn't do it the first cycle. It was on both protocol and we paid for it. It was recommended by our re, however, when we found out the "negligence", she tried to downplay assisted hatching's relevance. My husband and I feel like they owe us a free cycle for the last frozen embie, and if that doesn't work they should give us a free fresh cycle to start over from scratch since we were told that the assisted hatching should be done to improve our chances and it was not done, both times. Now we are left with only one embryo, money down the tubes and devastated in more ways that I can describe.
Has anyone else been in a similar situation where such negligence occured? What did you do? We are about to consult a lawyer.

Well, quick update. I was approved for our next cycle to be free. We have one embryo left. My RE said it was our "last try" and I corrected her letting her know that no way we were giving up. I'm sure she'd like us to, because if this one doesn't take we are pushing for a free IVF cycle that includes the ovarian stimulation, extraction, fertilization, etc. She knows that is coming and I'm sure the company doesn't want to pay for it. Nevertheless, I had a sonohysterogram and endo biopsy on Tuesday. I was told everything looks beautiful and they don't expect any negative news on the biopsy. It was done as a precaution since I had two failed cycles. I just assumed it would take a few tries for success anyway. Our next cycle is in August. Thank you again, for everyone's advice and input. I am so sorry to hear about this.  Assisted hatching is well worth it.  My first ivf cycle failed, but my second one I did end up pregnant, they did assisted hatching with that one.  I did have a miscarriage, but that was due to chromosomal reasons.  What assisted hatching is, they take the outer layer called the zona pelucida of the embryo and poke a hole throught it either by laser or by using a special acid.  When the embryo continues to grow it will start to come out of this small hole and hopefully attach to the uteris lining.  When doing ivf the embryos are put in different solutions which can harden this outer shell of the embryo.  That is why it's almost a must after 1 failed ivf cycle.  With my RE she does it as part of the protocal after the first ivf cycle.  I would definitely push for a free IVF cycle.

sorry to hear such negligence.  I failed my first cycle at age of 38 even I want to do AHA but my RE said no, so I switch to other RE and I paid for AHA.  On the day of transfer, I found out they forgot to do it, so I need to wait 5 min. to have AHA done.  So next time, you need to ask them before transfering because they all don't care much.

How about trying donor embryos - it is really a wonderful way to save lives - and you can pick the maternal age!

Hi,
First I am so sorry to hear your protocol was not followed, there is so much doubt in these procedures without having to worry if the fertility clinic is doing their job.
I absolutely would push for a free cycle.  I'm interested in this assisted hatching, what is it?  My dh and i just finished our third ivf with icsi and i am definitely getting af, so we are left with three failed cycles i am wondering if asisted hatching is something that might help.
