Careless docs

Well, I have contacted 3 malpractice lawyers and all say the same thing. I have no case.  They say that the most I can do is give the MD a piece of my mind and maybe write a letter to the hospital he is affilliated with.  Apparently in the state of texas it is not enough to be fearful and anxious unnecessarily for over a year. At most it is carelessness on the doc's part. One lawyer told me that there are men coming back from Afganistan with no legs that haven't got a case. What that has to do with me I really fail to see. Anyway, I intend to go on with my life and be grateful that I am SVR. I am not going to waste anymore time on this. I can only hope and pray that this MD never misses such an important lab result again. Maybe this will make him more careful. The patient's he serves deserve better. Let this be a lesson to all of us. Good luck to all with the new PI's. I will be watching to see how all of you do.

Your right agatha.  SVR is a gift, even though you had to wait a year for it.  You now know what it's like to be on both sides of the fence; to live with the disappointment of relapse and then the adulation of SVR.  Many people treat and SVR and never have to walk down the desolate road of relapse.  It's so unfortunate that you had to walk it, especially when you had that gift all the time.  I'm glad even with all you've been through that you know SVR is the most important thing and your focus is getting on with your happy and healthy life.

Lawyers usually dont like to sue doctors......fred pritzker attourney in minnasota...His office may be able to refer you if you still want to sue...But I think the main thing here is you are SVR. I agree with trinity4...You must remember that you are cured or svr....Atleast you and him accomplished that together...How did he treat you. Did he give you anytime in his office. Did he look you in the eye. He did offer you tx. he didnt refuse you tx. You are SVR or Cured. Amen. Too bad you had to wait and worry for so long. Now it is time to celebrate and live the good life.

That is why in your other post i said to forget about it and go live your life. I knew you had no case.  Put all that energy into living and enjoying your HCV FREE life.

I'd trade places with you any day. You need to be able to prove harm and there is no harm in not reporting a negative test. How you "feel" isn't reason (harm) enough for a law suit. I believe you have to prove negligence as well. Did you call for your results? Were they misread? Even that isn't negligence.
