i'm glad you finally got it back. I agree about just putting it behind you HOWEVER, I would suggest that you file a complaint with the better business bureau or other such entity. This place has probably done this before or will do it again and the more complaints against them the better. Your complaint may also help someone ELSE down the road. It's not nearly as much hassle as a lawsuit...you go to your local BBB website and fill out the form and they research it etc. Worth checkin into atleast.
I have been thinking about that but in all honesty I just want this to be put behind me.
My son didnt miss any school, I found a way to get him there everyday. My MIL never asked for money and even went as far as buying us lunch:) As for distress...O yah I could sue for that I remember now being so mad that I thought my heart would beat right out of my chest!! I just want to forget about it.......yesterday after I got it back I had a little scare though. I left the dollar store and couldnt find my van!!! A big truck was blocking my view!! I felt kinda silly after I realized it:)
Karma is a bit** !!! Im going to leave it alone and move on....they'll get whats coming to them!! If it ever happens again............. They better have a good lawyer, lol!

any school your children missed, any gas $'s you paid to your MIL, any *distress*(hint, YOU/BABY)...
i'd still honestly consult a personal lawyer, you have no idea what that original lienholder may have up their sleave, they may have given back the van, but they could be waiting to stir more trouble, plus, you don't want it happening again...
Yeah!!!!! I got my van back today!! I am still a little mad though, I didnt even get an apology!!! You would think they would be kissing my feet to ward off a lawsuit!! But I suppose I should just be happy to have it back , right?
I was so excited that I went to the grosery store, the pet store, the dollar store and Mc Donalds so my kids could play in their playland!! I guess I should be more carefull with the cost of gas but I was just so happy to be able to get some stuff done!! I will worry more about that tomorrow:)

So I still have no van!! My temper is hanging on by a thread! My hubby told me just today that we have to let his job (my lein holder) take care of everything!! HUH??? They arent doing sh**! They gave the old lein holders untill today to figuar out that it isnt theirs and thats it....yeah, Im still waiting!! They are going to get their lawyers involved it we dont get it back today....I dont believe them!! My hubby and I are argueing about it now and Im so frustrated!! I want to just go up there with the police and get back whats mine!! I dont give a **** that they were off this weekend!! I wasnt!! And I didnt have a vehicle to get around in!! I plan on making their lives a living hell if my hubby would get out of my way and let me deal with it!!!
I dont think anyone but me and my hubby realize that this is upseting our lives...they are taking their sweet time cause to them its no big deal!! UGH!! I should sue them for pain and suffering!!!
I'm suprised that the police didn't know where your van was. In Texas, before one can repo a vehichle, they have to report it to the police so they aren't out looking for vehichle that was stolen to begin with. Plus that gives you starting place when you are trying to find out who has it.
Found anything out about your van? I hope you have it back by now.

Thanks I really do hope this gets fixed tomorrow...I really hate not being able to go anywhere with out asking for a ride for me and my kids:( Today I had to deal with my MIL just to pick up my son from school! She always seems to drive me nutz but now that im pregnant it is even worse:( Its everything from her driving to her forgetfulness. Befor she would take me home though she had to stop and get her mail from the post office, stop by walgreens and go to wendy's mean while my kids are fighting in the back seat and crying cause they want to get home and play outside with their friends befor dark! It was such a beautiful day, lots of sunshine and I spent it dealing with my van and sitting in the car with my crazy MIL...she means well and I do appreciate it, but my goodness I want my van back!! Life is so unfair:(
Wow that is definitely one big mess! I hope that everything works out and you get your van back ASAP! You may still be able to sign your son up for the bus. I rode the bus in school and it wasn't bad!
Well they cant say that it was stolen because we have proof of abandonment and had sent them a certifide letter that someone from the company signed saying they resived it. No response came after 45 day. It was sold to me after 2 more weeks of waiting. I did think it was weird that no one from the lein company had contacted the impond lot. Today they said they didnt resive anything, but we have proof that they did!! We have already collected all the paper work on the van and thats what we brought with us to the repo company.......it didnt do much good:( The owner of the repo company did feel kinda bad considering that everything we had showed that we owned it. He said it was up to the original lein holder! and that he couldnt release it with out there consent!
But yeah the state would not have givin me a clear title if there had been a lein on it...we had everything done legally, all the paper work was in order.
ya'll are better than i am! i'm hormonal and practically everyone knows i'm the queen of "getting things returned" lol.....OH here's something else!!!
*****when a VIN is run through DMV/DOT/DPS to transfer ownership, then it would have stated there was a lien on it!!!!! and had there been a lien, the state would have had to contact the lien holder and alert them to what was going on and how it is to be handled.....not only that, you need to contact a COLLECTIONS LAWYER.....they'd help better than most, b/c here you've got a clear/clean title, proof of sale, proof of abandonment, hub's employment should have all records since taking possession of the vehicle.....THIS makes it a little "illegal" as how long have you had the van?????

i hope the next few days get better for you, and i'd definitely fight it, b/c if they were able to repo it, G_D only knows what else they could to do it, and ***not to scare you*** but hopefully they can't/don't find a way to say the vehicle was stolen when you took over possession.....
Thank you too!! I am going to do this basicly the way LosingmymindinGA suggested only call the police before a laywer, because legally the vehicle is mine and maybe the police can order it back without having to involve a lawyer:)
I hope that there is some way to get compansation for this!! They should have investigated a little better before they just come and take my van!! The way they went about it...I still consider it STOLEN!!
Thank you so much, That is the plan for tomorrow unless Hubby desides to take care of this himself:( He is so mad I am afraid he will do something to make this worse!! So far he has tried to stay calm, which is very hard for a man with his temper, lol!
Oh my gosh I am so sorry that you are having to go through this. I honestly would call your lawyer or call the police and have them look at the title or go to the MVD to see who's name is on the title (obviously you). That way maybe the government can make them give it back.

It sounds like you've had a really rough day. I'm sorry! I hate how companies can be so stupid. If I were you I would call a lawyer first thing in the morning and explain the situation. Find one that does a free consult on the phone. Next, if you haven't already, get your hubby's company to give you every shred of paper work they have on that van starting with HOW they got it, and the chain of events leading to it being declared abandoned. Next, call the old lienholder and TELL them, don't ask them...say "This is the situation, YOU repoed MY van, I have nothing to do with the old owner, i bought and paid for this van and own it legally. I have already contacted a lawyer and I'm giving you 2 hours to get my van released to me or we will take this to the next step. In addition, I want you to make SURE that you have it documented that this vehicle is no longer owned by the previous owner becuase if this happens again there WILL be a lawsuit. If I do not have my van back in 2 hours, I will not only seek for the return of my vehicle, but for damages as well. This is where I can be reached when my van is ready to be picked up..(give them your number) " and hang up...wait two hours if you don't hear anything...file a complaint with the courts.
Just a suggestion, that's how *I* would handle it. I really hope everything works out I know how frusterating it can be.
Its not like I have extra cars just laying around in case something like this happens!!!
