I'm not sure but I would think that the pharmacy probably has an obligation to report this to the authorities. If I were you, I'd go talk to an attorney and find out what you need to do.
Obviously, you're addicted - are you READY to stop!? If you are, do it NOW! If I were you, I'd do it now anyway. Good luck!

i am sure you will at least be "red flagged" by the DEA. any future scripts will be scrutinized very carefully. this can also hurt you healthcare insurance eligibility. this computer age is a whole new ball game. an attorney is a good idea. seeking counselling is always a good preemptive strike in anything that may end up before a judge. good luck
Are you kidding me?....do doctors still leave prescription pads laying around. I have not seen that since I was a child???......dang it!!
I don't think it's up to your doctor. I am surprised by his/her reaction, as it is their license at risk too, right?....I hope you din't try to write yourself a prescription for 180 tabs. I knew a woman who used to do that 25 years ago. Doc would give her one refill for valium and she would add her own "0" times sure have changed.....

I suspect that the doctor didn't actually blow it off as much as he didn't want to speak to you. You should really consider a rehab facility..to save your life and possibly keep you from jail. A young lady I just went to rehab with was charged with 7 felonies and 12 misdemeanors when she was arrested. BECAUSE she's done rehab and stayed clean 5 months, she had that knocked down to 1 felony and 1 misdemeanor. 5 years probation was all she got (and she's having that taken off when she completes probation). Proves that the court will help those that try to help themselves.
Not only should you seek treatment and a lawyer The phar. has probally black-balled you in the system.
This could be a blessing in disguise...God doing for you what you were not able to do for yourself.
Prepare for the worst and pray for a fly-by. I would be getting real active and transparent with my desires to get clean.

yeah you prob busted for sure. i see this 2 times this week on here. i was never "brave" enough to do this, thank god! you might be lucky. i WOULD go to rehab, or atleast talk to a lawyer.
I have been clean or lets say was clean for 5 years. After this root canal I was pressing my luck and in pain. Guess thats why you don't screw with fate. I'm praying that this breezes by for the health of my marriage and my kids. What an ignorant mistake. The lawyers I spoke to advides me to hang tight and ride it out. The doc still is being cool , I spoke with him today and he said he's not pressing charges...thank you Lord. Thanks for all your comments. Man I was so sichk of being a prisoner to a pill just like I was when I was an addict that I quit subs head on. Cold turley. It was like coming off the ops just minus a few degrees. When your in the right mind set and you truely want to set yourself free you can do ANYTHING for a few days to get to that beter place. I was on sub's for 2 years!! Clean for 5 now. Just had my first flub..as I like to call it. Wish you well and remember that you can do ANYTHING for a short amount of time.

I just spoke to my uncle who's an attorney. He said it's not up to the doctor if charges are made. There was no crime against the doctor. The crime was against a federal statute. He said it's up to the pharmacy to turn it in, the detectives to look into it, and ultimately the DA to press charges. The doctor has no say what so ever.
no wonder then my doc is beinng so lax. thank you for asking you uncle. that's alot of help in knowing what i am to expect. wonder if the pharmacy always turns them in. should i call the pharmacy or call the police? want to get this resolved and get the monkey off my back
It all depends on the doctor mainly, because they are HIS prescription pads that were forged.
If the doctor decided to blow it off, then consider yourself lucky. Generally the pharmacy would call the police and when you came in to pick up the pills they would arrest you right there.
All pharmacies have access to a database that allows them to pull up a prescription record on ANYONE. It's called a "PDMP". Most likely this pharmacy will note it on your name for future pharmacies to know your rap.
Do not call the pharmacy, do not call the doctor, do not call the police. If any action were going to be taken by either one of the three, it would have been done by now.
If you are addicted to pills, the best thing for you to do would be to get into a recovery program right away so you can detox safely and work on your future.
BTW I have worked in the medical field for over 10 years now. I am also addicted to Vicodin. I have seen many patients forge scripts, lie for refills, detox, you name it. I feel pretty comfortable giving you advice!

We have patients that have been in similar situations like this, and usually the police started with our office and then down the line, so I always saw it as the doctor's call. I know a pharmacy CAN press charges, but I've only seen it once and it was on a "repeat offender".
Anyways I still think you should just go to treatment- if you do go to court and you don't have a long police history most likely the judge will offer you treatment over jail time.
Pharmacy has the right to contact the DEA and even though the doctor said it was nothing to worry about does not mean he wont turn around and press charges he has to protect himself .That's why you need to contact a lawyer there are a lot of what ifs
Big question on script.
I recently had a Doc change a frequency (less) on a pmed script. The pharma then said well you now have some tabs so they should last you longer..... I had a new script. Thought if you changed the dosage that was automatically refillable.
Some of these Pharmas are a real hoot to deal with.
if they INCREASE the dosage or change the frequency of the dosage or the quantity of the dosage, yes, they can fill another scrips.however, if they reduce they dosage and you are within the framework of the original dosage and thus SHOULD have some left, they don't have to fill it.

Great info thx. The thing was the pharma started doing the refill math based on the NEW script. The intention was - finish your other dose (about 6 days worth etc) then go to the lower. She calcs up well lets see based on the NEW instructions you now have 33% more. So instead of refill in 6 days now its like 9 or so based on the one they HAD NOT filled yet.

I'm a CPhT and know that the charges will not come from the prescribing [or lack there of] physician -- but will instead come from the pharmacy itself. ANY time a pharmacy gets a situation at hand like this, they are liable by law to contact the DEA with offenses such as fake, forged or copied prescriptions such as the one you attempted to get filled. Whether it was your regular pharmacy you go to or not -- they are still held accountable for situations like this, and can not jeopardize their pharmacy license for simply ignoring the law, if this makes sense.
You've received a lot of amazing advice here from members, and I feel the best thing for you to do at this point in time would be to contact a lawyer [which you have already -- assuming] and go from there. IF you feel that this was done because of an addiction that you once had in the past coming back to get to you, then seek professional and/or medical assistance for this as well.
I just called a sub treatment center. Looks like thats not an option..

I know this does not actually go along with the orignal subject that has been talked about but I have a question. I know someone that ODed on Vicodin and other prescription meds. for Bi-Polar. This person was taken to the hospital and voluntarily committed themselves. The hospital had the meds. which the person had taken and at time of discharge was gave the meds. they had ODed on. Now it is on there medical records where they have been black-balled and can not get a prescription for pain. I wonder why the pharmacy at the hospital gave back the prescription meds. on discharge if they were going to be sent home and black-balled? This does not sound right to me. Does anyone have an answer to this? Is there anything this person can do to get off this black-balled list?
re: DaveSage....I take 2 klonpins (2mg/ 2xday for anxiety which I hope to start tapering off of this fall)..last time I saw the doc he gave me a script for some with 6 refills (a computer generated script for me to take) somehow, it was also faxed to the pharmacy for the same amount,same date, etc...I knew he had goofed...I asked the pharmacy if I can use the written when the faxed version was up and they said "yes" but just to be sure I'm going to check with the doc. I suspect if I had turned that in for fill that day while they were handing me the already filled fax script I;d have a lot of questions to answer.
