Clarification of HIV being an in-host virus

Maybe I didnt word my topic properly but from what I have been reading on this topic, HIV must occur with penetration (even though one does not know if there is cum/precum etc). If a male ejaculates on or near the vagina with no prior penetration only just rubbing of his penis does this count as a risk? Just checking as the info is quite confusing. Thank You for the clarification.

Ok let me make it clearer, if a guy like masturbated himself got cum on his fingers and then proceeds to finger the female partner...is that a risk? so no penetration = no risk irregardless there was ejaculate near or on the vagina?

So no penitration occured just some rubbing on the vagina and then ejaculation outside of the vagina...no it is not a risk for either person.
