Herpes can be transmitted through contact skin to skin, same as syphilis, but in both cases you would have to touch the lesions that both infections cause on skin. You can test for syphilis 6 weeks after the encounter, and if you get it negative, it would be interesting to re-test 3 months after the intercourse, as there are people who take longer to show a positive result. For herpes you can test 3 months after the encounter.
I have actually tested for syphilis and it is negative too . But I am yet to receive herpes result
