Having my daughters step father adopt her

Okay so my fiance & I are due in April, and getting married soon after. I didn't want to get married while I was pregnant. I would like for my 6 year old daughter to have the same last name as the rest of the family, and be a part of it officially. Currently she has my maiden name, not her fathers. Her father has barely been a part of her life, & when he has, it's been more about him wanting me back. Now that I'm pregnant with my fiance, her father hasn't contacted me about her in months. My fiance has been more of a father to her this past year then her father ever has. Also, her father has absolutely no legal rights to her, I have just let him see her. Would we need his permission to let my fiance adopt her? Once we're married of course. I know for a fact that her father would refuse because he is so upset that I have moved on with someone else.

It think you would need his permission to actually adopt her but since she has your last name I think you can change it to whatever you want I was born with my moms last name and she later changed it to my step dad's but he didn't adopt me

It's more leal than that f her original father is on the birth certificate  trust me I'm going through the EXACT same thing with my 3yr old. He has sign off parental rights. Like mine he refuse to be spiteful and won't so I have to go to court and get a judge to do it because he hasn't been around for yrs.

Just do it! I plan on doing that with my fiances son after we get married. Who cares what her dad thinks, he's not taking care of her like your fiance is. I hope everything goes well :)
